Brazil court denies habeas corpus of rancher charged with murder of Dorothy Stang

Brasília – The court of the state of Pará rejected unanimously, on Monday (September 16), the habeas corpus petition filed by the lawyer of rancher Vitalmiro Bastos de Moura, also known as Bida, sentenced to thirty years of imprisonment for being one of the masterminds behind the murder of American missionary Dorothy Stang, in 2005.
Bida, who has been on trial three times – he was found guilty twice, and not guilty once – is standing trial by jury again on Thursday (September 19). After his third trial was nullified by the Supreme Court in May this year, he was put in a regime in which he is allowed to work outside prison, but has to spend the night in his cell.
Sentenced to 30 years in the first trial, in 2007, he was subsequently released in 2008, in a second trial, which was nevertheless nullified for fraudulent proceedings. In the third trial, which lasted for over fifty days, Bida was once again found guilty, but his lawyers found a way to have his sentence revoked by alleging Bida’s defense had been restrained. The effects of the first trial remain valid until the new trial confirms or modifies his sentence.
For Edson Cardoso de Souza, the attorney in charge of the Dorothy Stang case, the habeas corpus petition filed shortly before Bida’s trial was a strategy adopted by his lawyers to try to manipulate the jury, since Vitalmiro Bastos de Moura is currently serving overnight jail time.
Dorothy Stang was shot to death in the Brazilian municipality of Anapu, in the state of Pará, on February 12, 2005. The Public Prosecution Office declared that the American missionary was murdered because she fought for field workers to be given legal ownership of public lands claimed by local farmers and loggers.
