Brazil's prosecutor-general rules imprisonment for Argentine torturer

Brasília – Brazil's Prosecutor-General, Rodrigo Janot, has recommended imprisonment of Manuel Alfredo Montenegro to the Supreme Court (“STF”). Montenegro is accused of committing torture during the military dictatorship in Argentina. Interpol reported that he current lives in Rio Grande do Sul, south Brazil.
The Prosecutor-General's Office (“PGR”) reported that Montenegro's arrest was ordered in 2011 by the Lower Court on Criminal Matters of the Misiones province in Argentina. He is accused of unlawful arrest and torture of three people when working as a federal police officer in his country between 1972 and 1977.
Janot found the arrest order meets the legal requirements and referred to constitutional provisions that foreigners who arrived in Brazil after committing crimes in another country be extradited. The Prosecutor-General understands that crimes against humanity committed during dictatorial regimes do not become time-barred in either country. “The issue of time bar in crimes against humanity is not subject to the 1988 Constitution's approach to the Amnesty Act. These are separate and independent legal matters.”
