Temporary jobs during World Cup and Olympic Games may change Brazil’s labor laws

Brasília – A change in Brazil’s Consolidation of Labour Laws (“CLT”) will be made by means of a provisional measure in order to allow short-termed agreements – contracts of up to 14 days and no formal register. The initiative is an attempt to facilitate the recruitment of new workers for the 2014 World Cup and 2016 Olympic Games in Rio de Janeiro, as well as to boost tourism in the country. The measure will be submitted to the Civil House of the Presidency of the Republic by the Ministry of Labor.

The initiative was announced on Tuesday (Dec. 3) by labor minister Manoel Dias during the 48th meeting of the National Council for Tourism (“CNT”). Another measure is under consideration which relieves ships of the obligation to have 25% of crew members made up of Brazilian citizens if they carry tourists to the country.

According to him, the measure will establish a period of 60 days every year in which employers will be allowed to hire under this system for 1 to 14 days. Thus, for instance, sixty one-day contracts or a single fourteen-day contract: “In order for this to be possible, we need to change Article 455 of the [Consolidation of Labor Laws], so that a legal device is added – 455 A – and short-term jobs are legalized. It’s been a demand made by the tourism sector for a long time, approved by representatives of employees, employers and the government in the discussions promoted by the Ministry of Labor.”

The minister went on to say that, since the World Cup starts in a few months, several sectors of the government will have to work hard so that the measure is passed by Congress and turned into a law as quickly as possible.

He further announced another initiative to promote tourism and benefit workers directly: the extension of the Travel More Program (Portuguese: Programa Viaja Mais), which already reaches the elderly. The Government Severance Fund (“FGTS”) will be available for use in holiday trips in off-peak season. Loans will also be made easier so that people are able to afford these trips.

The initiatives announced by Dias were met with approval from tourism minister Gastão Vieira. He said the tourism sector is ready to take in the jobs created after the new labor laws are passed. Vieira reported that the National Program for Access to Technical Education and Employment (“Pronatec”) has already trained and recruited 120 thousand people, who will take up positions yet to be created. Their goal is to reach 240 thousand training programs offered through the initiative.
